Consumer Purchase Terms and Conditions

These Consumer Purchase Terms and Conditions (the “Terms”) are a legal agreement between You (“You” or “Customer”) and Rad Life Mobility Inc., a Nevada corporation (“RLM”, “us” or “we”), and apply to all consumer purchases by You of any model of electric bike (“ebike(s)”) and/or related accessories or other products offered by RLM branded with the “Rad Power Bikes” mark (collectively with ebikes, the “Products”) in the United States only. Purchases in Canada must be made through that website and are subject to the applicable Terms and Conditions contained on that website.
- You represent and warrant that You are at least 16 years of age or the age of legal majority in Your jurisdiction (the “Minimum Age”), whichever is higher. If You are under the Minimum Age, You are not eligible to make a purchase with RLM.
- By purchasing any Products from RLM, whether online or at our showroom, or by using the Products You thereby agree to these Terms in their entirety. Acceptance of these terms is a condition precent to your valid purchase of Products.
- Please read these Terms carefully as they identify Your obligations and rights and include a requirement that all disputes that You may have under these Terms be taken to individually based arbitration, instead of a jury trial or class action, and that You waive certain rights relating to certain claims or relief.
Please note, terms for the other brands under the RLM house of brands (e.g., Serial 1, QuietKat) are set forth on the specific brand’s website. The Terms herein apply only to Rad Power Bikes-branded Products.
1. Application
These Terms apply to Your purchase and use of the Products. Other interactions that You have with RLM are subject to other terms and conditions, including the:

A copy of these Terms and all other documents which apply to Your purchase of Products are available for You to read on our website. Our Privacy Notice describes how we collect, use, and disclose personal information; it is provided for Your information and does not constitute a contractual term of these Terms.
2. Ebike Online Or In-Store Orders
In the event You are purchasing an ebike (i) by ordering online, (ii) in an RLM retail store (as opposed to a direct purchase in store of in-stock item), or (iii) through Rad Service, Your order of an ebike is an offer to buy. RLM will send You an email confirming our receipt of Your order. We reserve the right at any time, even after we send You a confirmation email, to decline or cancel Your order or to limit order quantities for any reason, including, but not limited to, errors or suspected fraud.
a. Orders Placed Via Affirm. Orders placed using Affirm as a payment method via www.radpowerbikes.mom must be shipped and cannot be picked up in store. If You would like to pick up a bike from our Seattle store and purchase using financing, You may do so at the time of purchase at our shop at the following address: 1121 NW 52nd Street, Seattle WA 98107.
b. From time to time, in its sole discretion, RLM may promote special offers, codes, or referral programs for certain sales or product launches. Special offers, codes, and referral programs may not be used in combination and RLM reserves the right to end or pause all such offers, codes, or programs at any time.
3. Shipping
Shipping costs for Products are as follows.
Bikes
- Bikes shipped within the contiguous US: free shipping
- Bikes shipped to qualified Alaska zip codes: $400 per bike
- Bikes shipped to qualified Hawaii zip codes: $500 per bike
- Bikes shipped to zip codes that are not within one of the above categories: please contact customer service for further information
Batteries
- Full priced battery(ies) shipped within the contiguous US: free shipping
- Discounted battery(ies) (e.g., based on a promo or special offer) shipped within the contiguous US: $49 per battery
- Any battery(ies) shipped to qualified Alaska or Hawaii zip codes: please contact customer support for further information
- PLEASE NOTE: DUE TO SHIPPING REQUIREMENTS FOR HAZARDOUS MATERIALS (E.G., LITHIUM ION BATTERIES), ALL BIKES OR STANDALONE BATTERIES CANNOT BE RETURNED

We do not ship to Puerto Rico, other US Territories, PO boxes or APO/FPO addresses.

General Shipping Information
- A shipping confirmation email will be sent to the email address provided for the order once the order has shipped.
- We will use FedEx or other parcel service to ship Your order. We DO NOT ship to PO BOXES or APO. Please note we are not responsible for any lost, stolen, or damaged items due to the actions or inactions of FedEx or any other parcel service.
- Online purchases made on our website at www.radpowerbikes.mom cannot be modified or cancelled once an order is placed. This cancellation policy applies to online purchases for ebikes and accessories. In-store purchase orders cannot be modified or cancelled once the order is shipped, including but not limited to changing the address, putting an order on hold, or updating shipping settings/preferences.
- Orders containing discounted merchandise may take an additional forty-eight (48) hours to process.
- You will be responsible for paying for Your own shipping costs for returning Your item. Shipping costs are non-refundable. We recommend using a trackable shipping service and purchasing shipping. We cannot guarantee that we will receive the item You are attempting to return.
- For any third-party shipping outside of RLM’s normal shipping process, RLM cannot provide ANY additional shipping information or documentation.
- Orders placed through our online store (www.radpowerbikes.mom) with the shipping address of an RLM retail location will be canceled. To purchase Products in-store, please locate an RLM retail showroom near You.
4. Built and Delivered Program Terms
a. If You are in eligible geographic areas and depending on availability, You may have the option of choosing to benefit from RLM’s Built and Delivered Program (the “BD Program”). Under the BD Program, Your ebike will be brought to Your specified address by an RLM representative pre-assembled, including any purchased accessories, for Your immediate use. The RLM representative will also provide a tutorial demonstrating how to use and benefit from the features of Your new ebike, including its operation and battery charging recommendations.
b. The BD Program is subject to an additional fee that can vary based on geography, which RLM may change at any time in its discretion. You will be given the opportunity to choose the BD Program at checkout and the applicable fee will be communicated to You prior to Your payment.
c. You will be responsible for scheduling a date and time for the RLM representative to deliver and assemble Your ebike. If You are not at the specified address to receive Your ebike at that date and time, we will contact You directly to schedule a new date and time. If You fail to be at the specified address a second time, You will be charged a $100 no-show fee.
d. All other terms and conditions contained herein will apply to Your ebike purchase. Your warranty will begin once Your ebike arrives with the RLM representative.
5. Ownership and Chargebacks
Title and all risk of loss for Products will transfer to You at the time RLM delivers such Products to the applicable shipping carrier. Any damage, loss, or defect arising after such delivery shall be resolved as between You and the shipping carrier and RLM bears no responsibility for damage arising from transport once the Product is tendered to the shipping carrier.
For products purchased at an RLM retail location, risk of loss passes to You (or anyone authorized by You to complete the pick up) upon physical possession of the Product, meaning the moment the Product is handed to, taken by, You. This transfer of risk occurs regardless of whether You have left the store or loaded the Product into Your vehicle or mode of transportation. RLM is not responsible for any damage to the Product, or to Your vehicle or mode of transportation or other property occurring during or after Your taking possession, including damage arising from Your handling, transport, or loading of the Product. If store personnel assists with loading, such assistance is a courtesy and does not shift risk back to RLM or constitute a waiver of the risk transferred as described above.
Notwithstanding the foregoing, please note the following:
- In cases where RLM provides You with replacement Products (whether under warranty or as a courtesy), RLM reserves the right to first require proof that the returned Product has been delivered to RLM’s approved transportation carrier or proof of disposal (as applicable) of the replaced Product(s) prior to providing a replacement Product. If RLM requires return of the Product prior to shipping out a replacement, RLM will provide You with a shipping label that allows RLM to confirm when the Product has been dropped off with the carrier. Such return shipping will be at RLM’s cost. If RLM requires proof of proper disposal, RLM will provide reasonable instructions as appropriate, e.g., providing a photo showing the Product has been dropped off at a recycling center. In the event You fail to return or fail to provide proof of disposal (as applicable) RLM reserves the right to defer provision of the replacement Product pending receipt of the required information. Upon satisfaction of the noted requirements, RLM will send the replacement Product without unreasonable delay.
If you are unable to comply with such requirements despite good faith efforts, RLM will work with You to arrange an alternative return or disposal method. - If You obtain a refund, credit, or reversal of payment relating to a Product through your card issuer, financial institute or otherwise (“Payment Reversal”), and You retain possession of the Product without completing the return or disposal requirements described above, RLM reserves the right, in its reasonable discretion and in addition to any other right or remedy available to RLM at law or equity, to pursue any one or more of the following, cumulatively, following written notice and reasonable opportunity (not less than 7 calendar days) to complete the return or disposal requirements – except where RLM reasonably determines that the Product presents a safety hazard or that notice would be futile: (i) require immediate return of the Product, at RLM’s expense; (ii) invoice You for, and/or pursue collection of, an amount equal to the original price paid of the Product, less any amount already recovered by RLM (if any), through a collection agency, small claims action, or other lawful means; (iii) report the transaction to fraud-prevention and/or decline to process future orders or transactions with You, in RLM’s discretion and consistent with applicable law; and/or (iv) pursue any other remedy available under applicable law. Nothing in this section limits any rights you may have to dispute a charge under applicable law, or waives, limits or forfeits any statutory warranty right that cannot be lawfully waived or conditioned.
RLM shall be entitled to recover its reasonable attorneys' fees and costs incurred in connection with any collection action, dispute, or legal proceeding arising from a Your chargeback, dispute, or reversal of payment for a Product You retain; provided, however, that this fee entitlement shall not apply to any claim arising under, or asserted for breach of, this or any other contract between RLM and You.
Notwithstanding any arbitration provision elsewhere in these Terms, RLM may pursue chargeback-related collection actions under this Section in small claims court, and such actions are expressly excluded from any obligation to arbitrate.
6. Return Policy
a. In order to undertake a valid return and receive a refund, You must start the return process by initiating a return on the “Start a Return” page or by contacting RLM at support@radlife.com. No refund will be issued for any merchandise sent back to RLM that does not follow this return policy (and any associated shipping fees will be Your responsibility). Not all Products can be returned and You should carefully review this Return Policy prior to your purchase or contact our customer service team for further information.
b. Order Cancellations: All purchases made from our website at www.radpowerbikes.mom cannot be modified or cancelled once an order is placed. Preorders ship based on the estimated time listed on the product page, if applicable. In-stock orders typically ship within 2 business days of payment confirmation.
c. Return to Sender / Refused Shipment: If an order is returned to the sender (RLM) or You refuse to accept delivery of the shipment, You will be responsible for paying return shipping fees on the merchandise, which fee shall be the at-cost fee for RLM.
d. Non-Returnable Merchandise: RLM will not accept returns of: (i) standalone batteries, (ii) Thule Yepp seats purchased from RLM, (iii) helmets (any brand), (iv) spare or replacement parts, or bike racks (of any brand). It is Your responsibility to ensure order accuracy. If you have any questions about Products You order, please contact our customer service team for assistance.
e. Returns of New Bikes: You may return any new bike to RLM within 30 days of receipt of the bike. The bike must be in new condition and in original packaging. If the bike has been used, it cannot be returned if there are more than 20 miles on the odometer. Customers will be responsible for paying the applicable return shipping fee(s) which will be the at-cost fee for RLM on the returned bike in addition to a 30% restocking fee. The return shipping and restocking fee will be deducted from Your refund amount. If You return a bike along with other Products such as accessories, the Return Policy terms shall still apply, e.g., if You purchase a new bike and a spare battery, the spare battery cannot be returned. Refurbished bikes purchased through RLM at a garage sale or through any third party are not eligible for returns.
f. Returns of Eligible Products: Subject to the limitations and restrictions in this Return Policy, Your return of eligible accessories or merchandise shall be subject to return shipping fees on each returned item and a restocking fee of 30% of the original purchase price on the item(s). The return shipping and restocking fee will be deducted from Your refund amount.
g. Refunds: (1) If you return an item purchased with a discount code or that is otherwise less than the MSRP, any refund amount will be solely for the amount you paid and not the full price; (2) RLM reserves the right to deduct charges for refunds will be issued after inspection of the returned Product and may be subject to deductions for damage and inspected.
h. Process: Please ship all approved returns using the shipping label provided to You during the return merchandise authorization process.
7. Ebike Performance
Please note that information on RLM’s Site or other manuals or documents regarding the expected range on a single charge on one of our ebikes is an estimate, not a guarantee. There are many factors that contribute to actual, real-world range for an ebike battery such as age of the battery, ambient temperature, level of pedal assist, speed, payload, and terrain. Based on the conditions, it is possible to get less than the expected minimum range or greater than the expected maximum range.
Any alterations, modifications, or other changes made by You to an ebike following Your purchase may affect the safety, operation, or mechanics of the ebike (including, but not limited to any component of the electrical system) and may void the Limited Warranty and shall be at Your sole risk of harm. RLM shall not be liable for any alterations or modifications You make to RLM’s products.
YOU MUST NOT alter, modify, or otherwise tamper with any electrical component of the product, including but not limited to the battery, battery management system, motor controller, wiring, charging port, or any related electrical system. These components are engineered and tested as an integrated system, and any modification may compromise the safety mechanisms designed to prevent overheating, short-circuiting, fire, or battery failure.
ANY MODIFICATION, ALTERATION, OR TAMPERING WITH THE PRODUCT'S ELECTRICAL COMPONENTS, WHETHER PERFORMED BY YOU OR A THIRD PARTY, CAN RESULT IN SERIOUS SAFETY HAZARDS, INCLUDING BUT NOT LIMITED TO FIRE, EXPLOSION, ELECTRIC SHOCK, PROPERTY DAMAGE, AND PHYSICAL INJURY OR DEATH.
RLM prohibits any such modification under any circumstances.
By purchasing and/or using the product, You acknowledge and agree that any modification of the Product's electrical components is undertaken entirely at Your own risk. RLM disclaims all liability for any injury, death, property damage, or other loss arising from or related to any unauthorized modification of the product's electrical components, and You assume full responsibility for any and all such consequences.
THE FOREGOING SAFETY WARNING PROVISIONS APPLY REGARDLESS OF WHETHER THE MODIFICATION WAS A CONTRIBUTING CAUSE, SOLE CAUSE, OR ONE OF MULTIPLE CAUSES OF THE RESULTING HARM.
8. Ebike Safety and Waiver of Liability
Please read carefully before proceeding with Your purchase.
In the event You fail to comply with these terms, You assume full responsibility for any personal injury or property damage resulting from Your use of the ebike and expressly waive to the fullest extent of the law, any claims related to the ebike relating to personal injury or property damage.
a. RLM’s EBIKES ARE NOT TO BE OPERATED BY ANYONE UNDER THE AGE OF 16. Children under the age of 16 may lack the necessary judgement and skill to safely operate the ebike, potentially resulting in damage to the ebike, damage to other property, serious injury, and/or death. You assume the responsibility to ensure the age of the operator is at least 16 years old and comply with Your local laws and regulations regarding operator age and other qualifications.
b. IN THE EVENT A MINOR OPERATES THE EBIKE IN VIOLATION OF THESE TERMS, THE PURCHASER WHO PERMITTED SUCH OPERATION ASSUMES FULL RESPONSIBILITY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOR THE RESULTING ACTS AND OMISSIONS OF THE MINOR. NOTHING IN THIS SECTION IS INTENDED TO WAIVE, OR SHALL BE CONSTRUED AS WAIVING, ANY CLAIM OF A MINOR WHERE SUCH WAIVER IS NOT PERMITTED BY APPLICABLE LAW. Please see the final provision of this Section 8 regarding the scope of the release of claims subject to this Section 8.
c. Riding any bike, ebike, etrike, or similar vehicle without a helmet puts You at very high risk of serious head injury or death. Always wear a properly fitted helmet that covers the forehead (this applies to rides of any distance) – this helmet mandate applies to You and any passengers. Many locations require specific safety devices. You assume full responsibility to familiarize Yourself and ensure the operator and any passengers adhere applicable helmet and safety laws or regulation where You ride.
d. Any bike, ebike, etrike, or similar vehicle is subject to wear and tear, and certain components and fasteners can stretch or loosen with the vibrations and stress of normal operation. You must check Your ebike/etrike before each ride and according to the other checklist contained in Your ebike/etrike’s owner’s manual. Failure to do so could result in property damage, serious injury, or death. You assume full responsibility to perform a pre-ride safety check on the ebike/etrike before each ride.
e. Riding any bike, ebike, etrike, or similar vehicle involve certain risks, including but not limited to the risk of serious injury or death. You assume full responsibility for the risks involved in Your use of the ebike, etrike, or related merchandise and related activities.
f. Incorrect assembly, maintenance, or use of Your ebike/etrike can cause component or performance failure, loss of control, serious injury, or death. You must read and understand the entire owner’s manual that came with Your ebike/etrike and any documentation provided for subcomponents or accessories before riding. You assume full responsibility for the proper maintenance and the proper assembly and/or reassembly of Your ebike/etrike. If anything seems incorrect or You have any concerns during assembly, please contact customer service so they can help You or direct You to a solution.
g. Using a damaged battery or charger can damage additional components or create a fire hazard. STOP USING YOUR BATTERY AND CHARGER IMMEDIATELY AND CONTACT RLM IF ANY OF THE FOLLOWING OCCUR: (1) Your charger’s flexible power cord or output cable or any of the electrical cables on Your ebike/etrike is frayed, has broken insulation, or any other signs of damage, (2) Your battery or charger is physically damaged, non-functional, or performing abnormally, (3) Your battery or charger experienced a significant impact from a fall, crash, or shipping damage, with or without obvious signs of damage, (4) Your battery was submerged in liquid or had extensive water exposure or damage, or (5) Your charger becomes too hot to touch (it’s designed to get warm with normal use), makes an unusual smell, makes a popping sound, or shows other signs of damage and, as soon as possible, recycle or otherwise dispose of it according to local rules.
h. To the fullest extent permitted by law, You agree to RELEASE AND HOLD HARMLESS RLM from all liabilities, causes or actions, claims, and demands that arise in any way from any injury, death, loss, or harm that You sustain or that any other person or any property sustained as a result of Your use of the ebike/etrike. This RELEASE includes claims based on negligence to the extent such claims may lawfully be released, and does not extend to any claim that cannot be waived or released under applicable law, including claims based on product defect where such a release is not permitted.
9. Pre-Orders and Backorders and Cancellations
Our pre-order/backorder process is for Products that are temporarily out of stock. For all pre-orders or backorders, Your credit/debit card will be charged immediately. There will be no delay in payment collection, regardless of when the item is expected to ship. Any cancellation of a pre-order or backorder is subject to our cancellation policy under Section 6(b) above. If able, RLM will provide You with a timeframe by which the Product will be available for shipment. If Your pre-order or backorder Product cannot be shipped within the timeframe stated at the time of Your order, we will notify You of the revised shipping date and of Your right to cancel Your order and receive a prompt refund, consistent with applicable law. In some cases, RLM may not be able to provide you with a specific timeframe regarding when pre-order or backorder Products will be available; in such cases, RLM will provide You with updated timing information as available.
10. Payments
Our website is powered by Shopify and all payments made by You to RLM are processed through Shopify’s payment portal. Payments may be declined or returned to You, in RLM’s sole discretion, for any reason or no reason at all. If we accept a pre-order of any Product, Your account, credit card, or other payment mechanism will be charged upon approval by RLM, regardless of when Your purchase is expected to ship. To the extent permitted by applicable law, if a credit card chargeback is issued with respect to a Product, RLM shall suspend performance of the Limited Warranty for that Product while the chargeback remains pending; please also note the chargeback provisions in Section 5. Nothing in these Terms limits Your rights under the Fair Credit Billing Act or other applicable law to dispute charges.
a. Tax. All applicable taxes (including sales tax) will be collected on all orders where such taxes are required to be collected.
b. Financing. For qualified purchasers, ebikes may be financed through RLM’s consumer financing partners. Please note: all financing partners are third parties and are not part of or representatives of RLM. The necessary qualifications for financing an ebike purchase, and Your rights and obligations associated with such purchase, are solely determined by the consumer financing partner. It is Your responsibility to review and understand all terms and conditions associated with financing an ebike purchase, and You hereby acknowledge that RLM is no way responsible for any such financing.
11. Liability
WE ARE ONLY LIABLE TO YOU FOR LOSSES WHICH YOU SUFFER AS A DIRECT RESULT OF OUR BREACH OF THESE TERMS AND WHICH ARE REASONABLY FORESEEABLE AND SUBJECT TO THE LIMITATIONS IN THESE TERMS AND RLM’S POLICIES AS SET FORTH ON THIS SITE. OUR LIABILITY FOR ANY LOSS OR INJURY SHALL, TO THE FULLEST EXTENT OF THE LAW, BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS GIVING RISE TO SUCH LOSSES OR INJURIES. WE ARE NOT LIABLE FOR ANY OTHER LOSSES OR INJURIES, AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY RECOVERY SHALL BE REDUCED IN PROPORTION TO ANY LOSS OR INJURY ATTRIBUTABLE TO YOUR OWN ACTS OR OMISSIONS. THESE TERMS DO NOT EXCLUDE OR LIMIT OUR LIABILITY (IF ANY) FOR: (i) DEATH OR PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (ii) FRAUD; (iii) FRAUDULENT MISREPRESENTATION; OR (iv) ANY MATTER WHICH IT WOULD BE ILLEGAL FOR US TO EXCLUDE OR ATTEMPT TO EXCLUDE OUR LIABILITY.
We recommend contacting Your insurance provider to determine if Your current insurance policy would cover You in the event of an accident. Please carefully review the waiver of subrogation requirement in Section 15 which is a material provision of these Terms.
12. Disclaimer of Implied Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS OFFERED BY RLM, INCLUDING BUT NOT LIMITED TO THE EBIKES, ARE WARRANTED ONLY TO THE EXTENT EXPRESSLY STATED IN THE APPLICABLE PRODUCT WARRANTY PROVIDED WITH YOUR PRODUCT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS ARE PROVIDED “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE” AND THE RISK OF USE AND PERFORMANCE REMAINS WITH YOU. RLM AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS DO NOT MAKE ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY, AND HEREBY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. SUBJECT TO THE FOREGOING AND TO THE APPLICABLE WRITTEN LIMITED WARRANTY, RLM, ITS AFFILIATES, SUPPLIERS, AND LICENSORS MAKE NO WARRANTY: (A) THAT THE PRODUCTS WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE OR PROVIDED ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; (B) THAT ANY INFORMATION OR CONTENT OBTAINED THROUGH IT WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (C) THAT ANY DEFECTS OR ERRORS THEREIN WILL BE CORRECTED.
13. Disclaimer of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RLM OR ANY OF ITS AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR PUNITIVE DAMAGES; FOR LOSS OF PROFITS, BUSINESS, GOODWILL, ANTICIPATED SAVINGS, OR USE; LOSS OR CORRUPTION OF DATA, CONFIDENTIAL INFORMATION, OR OTHER INFORMATION; BUSINESS INTERRUPTION; PAIN AND SUFFERING RELATING TO ANY ALLEGED PERSONAL INJURY; PROPERTY DAMAGE EXCEEDING THE LIMITATION OF LIABILITY IN SECTION 11; LOSS OF PRIVACY; FAILURE TO MEET ANY DUTY OF GOOD FAITH OR REASONABLE CARE; NEGLIGENCE; AND ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER, ARISING OUT OF, BASED ON, RESULTING FROM, OR IN ANY WAY RELATED TO THESE TERMS OR THE PRODUCTS, EVEN IF RLM, ITS AFFILIATES OR ANY SUPPLIER, OR LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION SUPERSEDES APPLICABLE LAW THAT MAY IMPACT LIABILITY FOR PERSONAL INJURY OR DEATH.
14. Acknowledgement and Indemnification
You acknowledge that there are inherent anticipated and unanticipated risks and dangers involved with the use of our Products, including the ebikes, whether intended or as a result of misuse. You understand that such risks can result in injury, death, illness or disease, physical or mental damage to Yourself, Your property, other third parties and their property, or to the property of RLM. You agree to release, waive, defend, indemnify, and hold RLM and its directors, officers, employees, agents, members, partners, suppliers, and licensors and RLM’s affiliates and each of their officers, employees, agents, members, partners, suppliers, and licensors (collectively, “RLM Releasees”) harmless and will keep them indemnified from any claim or demand, including reasonable attorneys’ fees, relating to or arising from: (a) Your purchase or use of any Products; (b) any violation by You of these Terms; or (c) Your violation of another party’s rights or applicable law. RLM reserves the right to assume, at its sole expense, the exclusive defense and control of any matter subject to indemnification by You, in which event You will fully cooperate with RLM in asserting any available defenses.
15. Waiver of Subrogation
BY AGREEING TO THESE TERMS, YOU SHALL AGREE TO MAINTAIN YOUR OWN INSURANCE COVERAGE AS YOU DESIRE TO PROTECT YOU AND OTHERS FROM ANY LOSSES EXCEEDING THE LIMITS OF LIABILITY IDENTIFIED IN SECTION 11 OF THESE TERMS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY AGREE TO WAIVE ANY RIGHT OF SUBROGATION THAT ANY INSURANCE CARRIER UNDER WHICH YOU ARE AN INSURED OR ADDITIONAL INSURED MAY HAVE AGAINST RLM AND/OR THE RLM RELEASEES. YOU WILL LOOK SOLELY TO THE PROCEEDS OF SUCH INSURANCE FOR ANY LOSS, LIABILITY, DAMAGE OR CLAIM ABOVE THE LIMITS OF RLM’S LIABILITY TO WHICH YOU AGREE IN THIS SECTION 15.
The foregoing provision means that any insurance company that provides coverage to You or Your real or personal property shall be precluded from seeking reimbursement from RLM or the RLM Releasees for any loss after such insurance company compensates You.
16. Dispute Resolution and Binding Arbitration
THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, AND THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN THE AMERICAN ARBITRATION ASSOCIATION’S COMPREHENSIVE ARBITRATION RULES. YOU AND RLM AGREE TO RESOLVE ANY DISPUTES BETWEEN US EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, WHICH MEANS YOU AND RLM WAIVE ANY RIGHT TO LITIGATE DISPUTES IN A COURT OR BEFORE A JURY, OR AS PART OF A CLASS ACTION, A REPRESENTATIVE ACTION, A CONSOLIDATED ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.
a. This arbitration requirement applies to any claim or dispute of any kind (whether in contract, tort, or otherwise, whether pre-existing, present, or future, and including statutory, common law, or equitable) between You and RLM, its affiliates, agents, employees, successors, assigns, direct and indirect subsidiaries, and any third party providing any products or services to You in connection with Your purchase that relates in any way to Your purchase of the Products, these Terms, or RLM’s marketing or advertising (“Claims”).
b. You still have the right to bring individual Claims in small claims court, to the extent that You qualify.
c. RLM will pay the arbitration/arbitrator fees.
d. Arbitration shall be administered by the American Arbitration Association (AAA), subject to its Consumer Arbitration Rules, available at (800) 778-7879 and www.adr.org
e. Discovery shall be permitted in arbitration subject to AAA Consumer Arbitration Rules.
f. The arbitrator shall have exclusive authority to resolve any arbitrability issues including any dispute over these Terms or this arbitration provision’s scope, application, meaning, and enforceability. The arbitrator shall be empowered to grant whatever relief would be available in court. Any award of the arbitrator(s) shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
g. Claims may not be arbitrated on a class or representative basis. You and RLM agree to arbitration only on an individual basis. Neither You nor RLM may join or consolidate claims of others or participate in any claim as a class representative or a class member. If any portion of this arbitration agreement is found unenforceable, the unenforceable portion shall be severed, and the remaining arbitration terms shall be enforced (but in no event will there be a class arbitration). This paragraph controls over any inconsistent term in any other agreement.
h. You and RLM agree that the arbitration will be kept confidential and that the existence of the proceeding and any element of it (including without limitation, any pleadings, briefs or other documents submitted or exchanged and any testimony or other oral submissions and awards) will not be disclosed beyond the arbitration proceedings, except as may lawfully be required in judicial proceedings relating to the arbitration or by applicable disclosure rules and regulations of securities regulatory authorities or other governmental agencies.
i. This arbitration shall be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA).
k. Informal Dispute Resolution. Before initiating arbitration, You and RLM agree first to attempt to resolve any Claim informally. The party asserting the Claim shall send the other party a written notice describing the Claim and the relief sought, and the parties shall attempt in good faith to resolve the Claim within sixty (60) days after the notice is received. Completion of this informal dispute resolution process is a condition precedent to initiating arbitration.
17. Notice and Updates
RLM will provide all notices that RLM is required to give under these Terms by any lawful method, including by making notice available through the Site or by sending it to any e-mail or mailing address that You provide to RLM. You acknowledge that if You do not provide RLM with current and accurate contact information, RLM may not be able to contact You. You agree to send RLM notice by mailing it to:

18. Governing Law
These Terms and any disputes between You and RLM will be governed by the laws of the State of Florida, without regard to conflict of laws.
19. General
Section titles are only for convenience and have no legal or contractual significance. Any list of examples following “including” or “e.g.,” is illustrative and not exhaustive, unless qualified by terms like “only” or “solely.” RLM’s failure to act with respect to a breach by You or others does not waive its rights to act with respect to subsequent or similar breaches. A waiver will only be binding on RLM if it is in a written document signed by RLM. If any provision of these Terms is held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining terms, covenants and restrictions will remain in full force and effect. You and RLM intend that the provisions of these Terms be enforced to the fullest extent permitted by applicable law. Accordingly, You and RLM agree that if any provision is deemed unenforceable, where possible, it will be modified to the extent necessary to make it enforceable, which may include its deletion.
RLM may assign its rights and delegate its obligations under these Terms, in whole or in part, at any time with or without notice to You, and these Terms will be binding upon and inure to the benefit of RLM’s successors and assigns. RLM shall have the right to assign these Terms, at its sole discretion, without notice to You. You may not assign, transfer or sublicense Your rights (if any).
These Terms (including any incorporated terms) and any Additional Terms constitute the entire agreement between You and RLM with respect to Your purchase and use of the Products. Both You and RLM warrant to each other that, in entering this agreement, neither RLM nor You have relied on nor will have any right or remedy based upon any statement, representation, warranty, or assurance other than those expressly stated in these Terms (including any incorporated terms) and any Additional Terms. The preceding sentence will not limit or exclude any liability that cannot be limited or excluded under applicable law. No one other than You and RLM, or RLM’s successors and assigns, will have any right to enforce these Terms.
20. Commitment to Respect
We understand that oftentimes when You call/email customer support, it is because something has gone wrong or there is an issue with Your purchase. We also understand that these potential issues cause frustration and sometimes anger; however, we will not tolerate rude/vulgar language towards our staff. Our team members are people – they try their very best to help our riders and we hope our Rad community shows them the same level of respect. We will offer a warning if conduct in violation of the expectation of respect occurs, after which we do reserve the right to refuse service, terminate Your account, issue refunds, or cancel orders, each at our sole discretion. We reserve the right to make any such decision final.

Supplemental Terms and Conditions Regarding RLM’s Battery Upgrade Program
The following terms are specific to RLM’s one-time Battery Upgrade Program (the “Promotion”) in place as of June 2026 (“Upgrade T&Cs”). These Upgrade T&Cs do not supersede the foregoing Terms referenced herein or RLM’s privacy policy (“Privacy Policy”), but are intended to be read in conjunction with all of RLM’s other applicable terms and conditions. In the event of any conflict between these Upgrade T&Cs and the Terms, these Upgrade T&Cs shall govern with respect to the Promotion. Nothing in these Upgrade T&Cs modifies RLM's Privacy Policy or any rights You may have under applicable privacy or data protection law.
The Promotion provides eligible customers with a one-time use discount code to upgrade their batteries to the newest Safe Shield® battery. Eligibility will depend on whether a compatible Safe Shield battery is available for Your specific bike model. Certain older bike models are not compatible with a Safe Shield battery. Not all batteries for the various ebike models are interchangeable. Please ensure proper compatibility on the battery product description page as batteries are not eligible for returns. If you have any questions regarding selection of the appropriate Safe Shield battery for Your bike, please contact our customer support team. Note, the availability of the discount code for eligible customers shall be subject to the other terms set forth in these Upgrade T&Cs and the Terms, including, but not limited to applicable shipping rates and the return policy relating to batteries.
The Promotion provides a discount of up to 50% off one (1) full-priced Safe Shield battery. The Promotion is limited to one discount code per email address for the purchase of a Safe Shield battery; the discount code may not be used for non-Safe Shield battery products on the RLM website (e.g., the discount code is specific to only a Safe Shield battery and not the purchase of an ebike or any other parts, accessories, or services). The discount code shall apply to one item only, not to an entire transaction. If two Safe Shield batteries are purchased in one transaction, the discount may be applied to the lower-priced Safe Shield battery. The Promotion cannot be used in combination with any other discount or promotion except as permitted (e.g., if you have received merchandise credit as part of the Promotion).
The Promotion shall apply only for so long as supplies last. The amount of the discount may be modified by RLM with prior written notice, which may include changes to the Upgrade T&Cs. Except as specifically noted herein, all of the Terms apply and remain in full force and effect.
